By accessing the M.E.L Travelistas website, you have agreed to the terms and condition and you are giving consent for M.E.L Travelistas to act on your behalf for your travel needs. These terms and conditions which acts as an agreement, describe what to legally expect from us when you purchase travel related services through us. The terms "we", "us" and "our" refer to M.E.L Travelistas, and the term "you" refers to the customer visiting our website, booking a reservation through us or otherwise using our services on behalf of yourself and others.



Our Agreement With You

Packages and Suppliers

We sell and promote a range of travel related products from different suppliers. Each Supplier has its own terms and condition that are applicable to your particular needs and we endeavor to inform you of them.

All bookings including flights are subject to price changes until the required payments are made. Any increased in charges will be at a cost to you and not us. In accepting these terms and conditions you hereby give your consent for us to charge your credit card for such additional amounts incurred.

Prior to planning and arranging your travel, a service fee form will be emailed to you for you to sign, agreeing to pay a service fee to us. The form must be signed, returned and the monies paid into the M.E.L Travelistas Stripe account stated below or any other method discussed. We do not accept cash or links payments.


Customized Design Fee Is Required For All Itineraries

In order to perform the professional services required to plan and arrange your travel, a fee is required which is non-refundable. Vacation planning involves much time and my work is based on years of personal experience and professional expertise.

Your final itinerary and documents will give you as smooth a vacation as is possible. All vacations arranged through M.E.L Travelistas offer peace of mind, as we are experienced professionals in the business of planning individual travel for travelers who demand the most professional individual attention to detail and execution of a well-planned vacation.



Deposits and Payment

Any deposits from you to secure a booking, unless otherwise stated is deemed as non-refundable unless otherwise stated. Payment of a deposit enables the suppliers to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and confirmation of the booking, and it is secured and subject to any terms and conditions of the Supplier. You will be advised at the time of paying the deposit when full payment is required. Upon receiving this information you are giving consent for us to debit your credit card with the relevant amount to the corresponding suppliers.

We reserve the right to refuse personal checks as a method of payment. If we have arranged a package, ground transportation costs are usually included, however on occasions the payment may be made directly to the supplier by you.

We are not liable for any double charging of your credit/ debit card or refunding that is not of our doing. We will endeavor to assist you if a problem arises. However, it is ultimately your responsibility.

We generally send documents to our customers electronically whenever possible.


Should a request be made for any documents to be sent as hard copies, an administration fee will apply.


Traveler Identification and Proof of Citizenship

The Transportation Security Administration (TSA) requires all airline passengers to provide:

  • Secure Flight Passenger Data (SFPD);

  • Full name as it appears on government-issued identification;

  • Date of birth;- Gender; and

  • Redress number (if available).

  • The name of Travelers on all reservations and travel documents must match the name as it appears on that Traveler’s government-issued identification.

  • Traveler is responsible for any fees and expenses that may be incurred due to an incorrect name or the denial of travel resulting from incorrect information.

  • Updated information regarding security measures and requirements for air travel are available at www.tsa.gov. Agency highly recommends that Travelers check this website well before travel.

  • All U.S. citizens traveling to or from any international destination must have a valid passport, which must be valid for at least six months beyond Traveler’s date of return.

  • Travelers are responsible to confirm current entry and exit requirements and to obtain the necessary travel documentation based on the country of origin, destination, and stops in any additional countries.

  • Minors of age 17 and under traveling alone or with a single parent may be required to have additional documentation on domestic or international flights.

  • NO REFUND will be issued for any costs or losses incurred as a result of Traveler’s failure to obtain or provide required travel documentation.



Cancellations and Amendments

Once we have purchase your travel package, your contract is now between you and the suppliers and they may amend or cancel your bookings. As your travel professionals, we will ensure that you are promptly notified through email in the first instance of any significant changes, once we become aware of such changes before your departure. However, we will not accept liability for any changes or costs incurred that may result in this action. You will then have the choice of accepting the change of arrangements or accepting an offer of alternative travel arrangements if one is made available by the Supplier, or cancelling your booked arrangements and receiving any applicable refunds as determined by the Supplier’s terms and conditions. We do not guarantee that any refunds will apply.

If we have booked you a flight and we are alerted to a significant schedule change by your airline before you leave your country of departure, we will contact you by email to advise you of this. Please ensure that you have given us and updated version of your contact email address and phone number, possibly your cell, and that you regularly check for messages before you leave. We have no control over any airline schedule changes or delays and we will not accept liability for costs which may arise as a result of cancellations, delays, changes or amendments.

If you are booked to change airports or flights, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight, making sure you have a confirmation number. Please note that for some airlines it is mandatory to confirm with them before you fly.


Your agreement with M.E.L Travelistas

Your Acceptance of the Terms and Conditions

In booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including any additional terms and conditions of any Supplier that are necessary to your booking, travel arrangements, tours or any website content. You are agreeing on behalf of yourself and those you represent to comply with all the terms and conditions, including any payments of all amounts due to relevant suppliers. You agree that any violation of any such terms and conditions may result in

  • The cancellation of your reservation or purchase,

  • The loss of any monies paid for your reservation flight, accommodation or otherwise,

  • You being denied access to the applicable travel related product or service dealing with M.E.L Travelistas and any third parties that work with us, and

  • Our right to debit your account for any costs incurred as a result of such violation.

We do not knowingly represent anyone under the age of 16 therefore, you have agreed that,

  • You are of sufficient age to use our services and website and can create binding legal obligations in connection with your use,

  • You are legally authorized to act on behalf of those you represent to conduct and make arrangements on their behalf and to accept these terms and conditions on their behalf,

  • You will ensure that there is only one person dealing with us to arrange the travel, eliminating any conflicting arrangements,

  • The information supplied by you and other members that you are representing is true and correct,

  • You are responsible for informing such persons involved of all terms and conditions applicable to their travel arrangements and

  • You understand that you are financially responsible for any use of our services or website by you and any parties using your name and information.



Changes to Your Booking

If a change is requested by you to your travel arrangements and is permitted and possible by the suppliers, our standard service fees will apply in addition to any additional Supplier’s charges. Please contact us to inquire about changes and if it is possible to request any changes. Please note that all reservation changes are subject to availability and the terms and conditions of the suppliers and the package purchased.

Name changes are treated as a cancellation by most airlines and Suppliers. We will endeavor to accommodate any changes if necessary, but please bear in mind that a charge by the airlines and Suppliers would apply under their terms and conditions.

Flights must be taken in the order they appear on your ticket or e-ticket confirmation. If for any reason you cannot take a flight as booked, please contact us in advance to discuss your options. You need to check in on time for a confirmed reservation, otherwise the airline may register you as a ‘no-show’, which could result in extra charges and/or your entire flight itinerary being cancelled and/or render your ticket void.

Accommodations

  • Hotel accommodation is subject to availability at the time of reservation.

  • Some hotels require NON-REFUNDABLE and NON-TRANSFERABLE deposits to guarantee a booking. In such cases, Agency will notify you regarding the NON-REFUNDABLE pre-payment for that portion of your travel.

  • Amenities such as elevators, air conditioning, bedding size, and similar preferences are not guaranteed at all properties. In addition, even if a property has amenities such as air conditioning or elevators, such amenities are not guaranteed to be operational or available during your stay.

  • Reimbursement for lack of amenities is solely the responsibility of the hotel. Agency may elect to act as an intermediary, but it is not responsible for such reimbursement under any circumstances.


Cancellation of Your Booking

In the event you cancel your booking , you may be entitled to a partial refund in accordance with the Supplier(s) terms and conditions. In addition to the cancellation terms and conditions of your Supplier(s), a fees will apply that will be outlined on your itinerary/booking confirmation. If you decide to cancel arrangements before the balance due date, the terms and conditions of the Supplier(s) will go into effect.

Generally flight tickets cannot be refunded if they are partially used. We are not responsible for a Supplier’s failure to pay a refund. NO REFUNDS will apply to any cancelled, unused, or partially used Travel Service. Hotels may not permit changes to or cancellation of reservations, subject to the terms and conditions of the hotel reservation.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim your cancellation charges through your insurer. Please read and review each document, carefully.



Airline Reservations

It is your responsibility to ensure that all of the details on your ticket and other travel documents are correct and you must bring to our attention any errors or discrepancies immediately after receiving your completed itinerary. Your travel documents are valuable and should be kept safe and secure. It is advised that you print 2 copies of your travel documents. Leave one copy with a close relative or friend and take the other copy with you. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.

Prior to booking international travel, we recommend that you review the Government’s prohibitions, warnings and advisories applicable to your destinations. By offering travel to a range of destination, we will not state you choice of destination is safe or without risk. However, we will advise you of any alerts and information relevant to your destinations.

  • Most airlines consider a name-change to be a cancellation.

  • You are responsible for excess baggage fees. Travelers are responsible to confirm airline baggage allowances for all flights.

  • International flights may have different requirements than domestic flights.

  • Tickets of any kind are payable in full at the time of booking.- Airline tickets, once purchased, may be NON-REFUNDABLE and NON-EXCHANGEABLE, subject to airline terms and conditions.

  • Agency is not responsible for any loss, accident, injury, delay, defect, omission, or irregularity that may occur, such as changes, additional expenses, and cancellations due to weather conditions, schedule changes, and other changes beyond Agency’s control.

  • You agree to adhere to safety guidelines of all airlines and hold Agency harmless from any liability due to airline restrictions.

  • Airline seat assignments are not complimentary on every airline.

  • Charges for pre-assigned seats in advance of flight time may be subject to additional charges.

  • Agency cannot guarantee seats in specific locations or next to each other. Seat assignments are strictly based on availability at the time seats are being selected and paid for.

  • Airlines retain the right to change aircraft and seat assignments at any time.

  • Agency is not responsible for any changes made by airlines or any additional charges imposed by airlines for any changes to seat assignments after selection and payment.


Passport, Visa and Immigration

It is your responsibility to fulfill and adhere to the passport, visa and other immigration requirements applicable to your destination in line with the laws of the designated country. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not adhering to any such requirements. We will advise you of what documents are required. However it is your responsibility to ensure that all your relevant documents are valid.

Entry Refusal

Countries may restrict entry for persons with criminal records. You are responsible to understand all destination entry laws and to know if you or anyone in your party has a criminal record. Agency does not inquire about Traveler criminal records in the interests of privacy. Refusal of entry is not a valid reason for cancellation, chargeback, or refund.

Insurance

Travel insurance is a vital part of your booking. We strongly advise that you take out adequate insurance for the duration of your journey. Travel insurance is mandatory with some travel arrangements and destinations. We may be able to arrange travel insurance to be provided to you through our suppliers and answer any queries you may have regarding the insurance, but we do not sell travel insurance.



Travel Advice and Vaccinations

We will advise you of any vaccination required. However, it is your responsibility to find out what is needed and make the arrangements for the necessary vaccinations pertaining to your itinerary. Should you need assistance, we will guide you to the necessary website for the country that you intend to visit. Travel Romantic Getaways reserves the right to modify these Terms and Conditions without prior notice. Your continued use of the site indicates acceptance of the modified Terms and Conditions.

Personal Information

You consent to Agency and Supplier use of your personal information. You understand that, as part of booking any Travel Services, certain personal information may be conveyed to third parties to accommodate your travel. Such information includes birth dates, passport numbers, travel dates, occupation, frequent flyer information, bank accounts, credit cards, and other information needed to secure travel arrangements. Agency will not be liable for the distribution of your information to any Supplier. Our liability for the failure of any foreign Supplier to protect your personal information is specifically excluded. You authorize Agency to keep your personal information for as long as needed to provide Booking Services and for a reasonable period thereafter for Agency’s legal or business purposes.

Arbitration

  • In case of a dispute between the you and Agency relating to or arising out of these Terms, we will first attempt to resolve the dispute personally and in good faith. If these personal resolution attempts fail, then we will submit the dispute to binding arbitration.

The arbitration shall be conducted as follows:

  • State of Texas, County of Dallas.

  • The arbitration shall be conducted by a single arbitrator, and such arbitrator shall have no authority to add parties, vary the provisions of these Terms, award punitive damages, or certify a class.

  • The arbitrator shall be bound by applicable and governing federal law as well as the law of the State of Texas, County of Dallas.

Each party shall pay their own costs and fees.


General

  • Amendments. These Terms may be amended only in writing by Agency.

  • Assignment. You may not assign any right or obligation under these Terms without Agency’s prior written consent, which will not be unreasonably withheld or delayed.

  • Waiver. No forbearance or delay in enforcing these Terms will prejudice or restrict any rights of you or Agency. No waiver of a right will operate as a waiver of any subsequent right. No right is exclusive of any other right, and each right is cumulative.

  • Severability. If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent permitted by law and the remainder of these Terms will remain fully in force.

  • Relationship of Parties. These Terms do not create an agent relationship, legal-entity partnership, joint venture, or employment relationship between you and Agency. You have no authority to bind Agency or incur any obligation on Agency’s behalf.

  • Notices. Notices under these Terms will be in writing and deemed given when sent to the receiving party’s email or other address provided for purposes of notice.

  • Counterparts. These Terms may be signed or accepted electronically in more than one counterpart; each will be an original. Counterparts together constitute a single instrument.

  • Governing Law. These Terms are governed exclusively by the laws of Texas without regard to conflicts of law provisions.

  • Further Assurances. You and Agency will perform any additional acts as necessary to effect these Terms and will address together in good faith any unforeseen issues that arise under these Terms with a view to mitigating any material adverse impact on either party.

  • Entire Agreement. These Terms, together with the Travel Services Agreement, is the entire agreement between you and Agency and supersedes all prior agreements, written or oral, between us regarding its subject matter.
